In a big relief to BJP's prime ministerial candidate Narendra Modi,
an Ahmedabad court on Thursday rejected a petition filed by Zakia
Jafri against the closure report of Special Investigation Team
(SIT) which gave a clean chit to the Gujarat Chief Minister in
connection with the 2002 post-Godhra riots case.Magistrate BJ
Ganatra in his one-line order said the court accepts the SIT report
in the Gulberg case. In total, the judgement runs into more than
100 pages.
Importantly, the magistrate said that Jafri can approach a higher
court. SIT lawyer RS Jamuar said, “No criminal case now can be
initiated against Modi, other accused,”adding, “SIT's impartiality
has been confirmed.” Zakia Jafri is the wife of former
Congress MP Ehsan Jafri, who was among 69 people killed in the
Gulberg Society massacre in Ahmedabad on February 28,
2002. Reacting to the court verdict on a news channel, Jafri
said, “Saddened by order but not disheartened, will appeal in a
month to High Court.” In her petition, Jafri had contended
that Gulberg massacre was cold-blooded conspiracy by Modi and
others to facilitate state-wide communal violence. She also claimed
her husband made frantic calls to the police and even to Narendra
Modi, who refused to send help.
The Supreme Court had appointed the SIT to probe Jafri's
allegations. SIT chief RK Raghavan filed a final report on February
8, 2012, which said there wasn't sufficient evidence to prosecute
Modi . Besides Modi, 58 others were given a clean chit by the
SIT. Following the petition by Jafri, the SIT had
strongly defended its investigations and termed the protest
petition a 'piece of fiction'.
Raghavan had said that was ready for the report "to be
scrutinized by anyone." Importantly, senior
advocate Raju Ramachandran, appointed by the Supreme Court to
investigate allegations of Narendra Modi's complicity in the
Gujarat riots, had said that there appears to be enough grounds for
offences to be made out against the Chief
Minister.

relief by an Ahemdabad court, Union Communications and Information
Technology Minister Kapil Sibal on Thursday tweeted that there is
justice beyond the trial court. The metropolitan court
dismissed a petition filed by a killed Congress leader's widow,
challenging the closure report of a Special Investigation Team
giving a clean chit to Modi and 58 others in a case relating to the
2002 communal riots. Petitioner Zakia E Jafri -- whose husband
and former Congress MP Ehsaan Jafri was among 69 people killed
during the post-Godhra incident riots in Gulberg Society here --
had contended that Modi and others should be tried for their role
in the riots conspiracy which had triggered violence across the
state.
The
Supreme Court-appointed SIT, which investigated Jafri's allegations
against Modi and others, filed its closure report on February 08,
2012 saying there was insufficient evidence to prosecute
them.The
ruling by Metropolitan Magistrate BJ Ganatra, upholding the SIT
closure report, spells major relief for Modi, the Bharatiya Janata
Party's prime ministerial candidate.

Scenario of National Level Political Parties in Assam
Currently, the state
government of Assam is ruled by the Indian National Congress (INC),
which is also ruling the Central Government. The chief minister of
the state is Tarun Gogoi. The political system of the state is
overseen by the Governor of the state. Currently, the Governor of
the state is Janaki Ballabh Patnaik, a former Congress leader. The
Governor of the state is helped in his functioning by the Chief
Minister together with his ministry, who are elected to the
legislative assembly of the state. The Indian National Congress has
been ruling the state since the country gained its independence
from British dominion in 1947. The party ruled the state till 1978.
In 1978, a Janata Party Government took over the control of Assam.
